Trend music in AI videos: can you use it in ads?

4 min read

You can use trend music in an AI video advertisement only when the applicable rights and license cover that use. Retaining the source audio does not transfer a license: personal posts, organic sponsorships, paid ads and publication on another platform need separate checks.

What are you publishing?

Use Check before posting What is not enough
Personal post Platform rules and permission for that use The track being popular
Organic sponsored post Commercial music scope and sponsorship disclosure Having no paid distribution
Paid advertisement Advertising rights and the chosen placement An earlier organic post being accepted
Cross-platform repost Permission for the new destination and territory Downloading the file with sound
Client delivery Whether the client can publish and advertise under the license Your generation subscription

Sources checked October 24, 2026. This guide organizes permission checks rather than clearing a particular track. Commercial licensing for client work covers the wider delivery, beyond music.

What does TikTok say about commercial music?

TikTok’s Help Center recommends its Commercial Music Library, or CML, for content promoting a brand, product or service. Its non-CML music licenses do not cover commercial use. Check the required authorizations when using other audio.

TikTok’s business documentation, updated July 2025 and read October 2026, includes commercial organic content, video ads and branded content in its guidance. A personal account or absence of paid distribution does not establish that a track is cleared for a promotion.

Look up the track in the context of the actual account and campaign. Check current terms and eligible placements. An editorial list is not a substitute for the selected track’s license.

Why does preserving audio leave rights unchanged?

Duble AI is our product. It places an influencer in existing footage and carries over the original recording’s sound. It does not compose music, create a new voice or dub dialogue. Audio in the output describes the produced file rather than a purchase of rights.

If the recording contains a third-party song, the visually edited file still contains that song. The video creator’s permission may not include the soundtrack. A music license also does not automatically clear the footage or the people depicted. AI influencer legality separates these layers.

The trend tutorial explains generation. Before advertising with a library clip, clear the selected material. Technical availability in a library is not a guarantee of advertising permission.

What is the difference between a song and its recording?

When reviewing permission, distinguish the musical work from the particular recording you will use. Permission from a singer appearing in footage may not cover all composition or recording rights. For Brazil, Copyright Act Articles 29, 31 and 89–93 address use categories and related rights. Other jurisdictions need their own review.

Describe the project to the music supplier: AI-edited video, brand publication, paid or organic distribution, countries and dates. Check whether the license permits delivery to a client and who may use the file. These are questions to resolve, not a claim that every library includes those rights.

There is no universal rule that a few seconds clear an advertisement. Brazil’s Articles 46 and 47 contain specific limitations rather than a general short-ad exception. Artist credit does not independently expand a license either.

Can you repost a TikTok video on Instagram?

Check the new destination. A TikTok-only permission does not establish rights for Instagram, YouTube or another advertising platform. We do not assume every commercial track has identical terms; read the document for the track and service you chose.

Record the covered platforms, eligible account, paid-media permission, duration and territories. If the new destination is missing, obtain the necessary license or prepare another version with suitable music. Use an appropriate editor for that change. Duble AI does not promise a music picker or audio editor.

Removing the music does not settle every other right. You still need to review footage, people and protected elements visible in the scene. The celebrity AI video guide explains why an AI label does not replace likeness permission.

Do you need both sponsorship and AI disclosures?

Treat the notices separately. In Brazil, CONAR’s 2026 guide addresses advertising identification and AI production. Disclose the commercial relationship clearly and check applicable AI notices separately. The platform disclosure guide covers that publication step.

For Portugal, the US or another destination, check local advertising and transparency requirements. A track license and a platform’s initial acceptance are not a legal review of the whole campaign.

What should accompany a client delivery?

Keep a copy of the authorization or license with the song and recording identity, supplier and date. Link it to the final delivered version. Record authorized destinations and limits, including whether the client must maintain a particular subscription or account.

If the track is not cleared, state the outstanding permission before delivery. For example, label a review file “soundtrack not cleared for paid media.” Do not promise unrestricted use or exclusivity in library music. Obtain the missing permission or choose a track whose license fits the campaign.

Frequently asked questions

Can I use trending music in an AI advertisement?
Only if the applicable rights and license cover that use. TikTok directs businesses to its Commercial Music Library and requires appropriate licenses for other sounds. Music being available in a personal post or retained in an exported file does not establish permission for paid advertising.
Does keeping the original sound in Duble AI clear the music?
No. Duble AI retains the source recording’s audio and does not generate music or voices. That technical feature does not license the soundtrack. Check music and footage rights for the intended platform, country and purpose before publishing or handing the result to a client.
Can an unpaid sponsored post still be commercial use?
A post promoting a brand, product or service needs commercial-use review even without paid distribution. TikTok distinguishes commercial content from personal uses and provides music guidance accordingly. For Brazil, also check CONAR advertising identification; elsewhere, consult the applicable local rules and the platform’s terms.
Does TikTok’s commercial library clear music for Instagram?
Do not assume that extension. Check the track’s licensed platforms, territories and uses. Permission for TikTok content does not establish rights for Reels, YouTube or advertising elsewhere. If the license does not cover the new destination, obtain appropriate permission or choose a different soundtrack.
Is giving credit or using a short excerpt enough?
Not automatically. Artist credit does not replace a license, and there is no universal short-duration rule clearing every advertisement. Brazil’s copyright law treats uses separately and exceptions have conditions. Other jurisdictions also need local review. Evaluate the actual material and intended use before publication.
